OUTCOME: Parenting time to Client and Hair Follicle Drug Test Ordered for Opposing Party
Late in the afternoon on a Friday, I was called with regard to an emergency custody matter that would be heard the following Tuesday. The minor child, only 2 years of age, was in an environment of purp...orted illegal drug use by multiple people and left for hours at a time unsupervised in the front yard, that bordered an extremely busy street. Up to this point, my client was denied any valuable time with the child but this did not stop the opposing party for filing an emergency custody action against him when he took the child from that dangerous environment, with the input of DSS and other law agencies. Because the Judge was not informed, the opposing party was granted custody outside of the presence of my client. However, at the hearing on that Tuesday, with the testimony of my client and his sister as to the gravity of harm threatening the minor child's welfare, the Judge was convinced that no emergency existed pertaining to threats from my client but rather was more concerned about the concerns of drug use by the opposing party. Against objection from the opposing side, our request for the Court to order a hair follicle drug test was granted and my client was provided significant parenting time with the minor child.

OUTCOME: Primary Custody, Child Support, and Child Support Arrears to my Client
This matter involved a baby between relatively amicable parties, but an absent parent for the first crucial months of the baby's life. The opposing party then decided to step into the child's life. Alt...hough my client appreciated ensuring the child had a supportive family with two parents, my client was also concerned about this sudden interest. This was weighed against some understandable concerns about the opposing party's ability to put the child first. With that stated, instead of creating resolution through talking, the opposing party filed a complaint for child custody with the courts. On top of this reality, the opposing party barely paid any child support to my client during the entire child's life. Therefore, my client filed a counterclaim for child custody and child support. At the conclusion of the trial, my client resulted with primary custody of the minor child and a child support amount that could actually assist her in the high fees associated with childcare. In addition to this, the Court also ordered that the opposing party pay a substantial portion of child support arrears for the year of missed child support payments and payments toward unreimbursed medical expenses for the baby.

OUTCOME: No Spousal Support Required to be paid by my client.
My client and the opposing party are in a contentious divorce that has lasted over a year now. During the proceedings, the opposing party requested for spousal support from my client indicating that he...r income did not cover her necessary expenses even after receiving a large child support amount. At the hearing, evidence was presented at her relatively high income in comparison to need and her ability to cover her own necessary expenses. Although my client made more money than the opposing party, we were able to display to the court that a difference of income alone is not a basis for spousal support. Rather, ensuring that the necessary needs of both parties and their children is the crucial determining factor. In the Court's ruling, my client was not required to pay any additional sum to the opposing party simply because he made more money than the opposing party.

OUTCOME: Custody to my Client
The matter began years prior when tensions between the parents led to their separation. Despite many efforts on behalf of my client, the opposing party would restrict his visitation to the two little o...nes mainly on the basis that she was the mother. Despite years of compromise, the opposing party increasingly would define when and what my client could do with the children. Of greater concern, at times she would force him to care for the children because it was convenient for her but in the midst of my client's work schedule. Due to continued erratic behavior and denial of valuable parenting time, my client was forced to file a complaint for child custody. From the very start to the day-long trial approximately a year later, I helped guide my client through the litigation process. On the day of trial, we overcame unsubstantiated allegations of child abuse and neglect by the opposing side, and the Judge granted a shared custody arrangement. In fact, the Judge gave more time to my client than we had even requested.

This touching case involved a baby torn between two parents in a troubling situation. The matter involved concerns of mental health and public image. I helped guide my client, in her fragile state due ...her broken home, through the competing legal claims, strained relations between the parties, and the contentious court proceedings. In particular, the opposing party made misrepresentations to the Court outside the presence of my client in emergency proceedings. Subsequent to filing the emergency motion, the Court granted the opposing party primary custody. At the date of the Temporary Parenting Arrangement hearing, I assisted my client in bringing to light the truths of the situation, which included serious concerns of mental health for the opposing party. The Judge reversed the emergency order and granted my client primary custody.

OUTCOME: Primary Child Custody to Client
Without my client's knowledge and while the two minor children were almost exclusively with my client, the opposing party filed a child custody complaint and a motion for emergency custody. Due to proc...edural issues and lies conveyed by the opposing party, the Court permitted the opposing party to have primary custody with my client only having limited hours every other weekend. After my client went to the children's school to find out that an Order had been issued against her without any prior knowledge of the case, she came to my office with tears in her eyes. Immediately, we filed the necessary documents to overturn this custody order. In as expeditious a fashion as possible, I was able to bring light to the opposing party's lies and completely reverse the custody arrangement. After the temporary parenting arrangement hearing, primary custody was back with my client and the opposing party had limited visitation. Also in said Order, it was noted that the opposing party has a propensity to lie which can now be used against said party in any future matters involving the same issues.
