Commonwealth v. Jerome Brown, 836 A.2d 989
Nov 14, 2003OUTCOME: In reversing the lower court, the Superior Court held that defendant was entitled to production of confidential informant's identity to refute averments in probable cause affidavit. The Pennsylvania Supreme Court affirmed at 582 Pa. 573
The detective claimed he used a confidential informant who alleged he bought drugs in an apartment building from Mr. Brown, who denied selling drugs during the time in question. We produced his apartme ... nt building sign-in logs and the security guards who checked in guests to support his defense. We asked the trial court to have the detective show where the confidential informant's name was on the logs to only the court. The detective and the prosecutor objected. The trial court refused our requests.
