Lehman v. Nelson, et al.

OUTCOME: Obtained a favorable appellate outcome on overturning and remanding the vast majority of the judgment amounts for our clients.

Published Ninth Circuit decision at 862 F. 3d 1203. Our firm filed and argued an appeal on behalf of Trustees of an ERISA / Taft-Hartley Trust Fund. The claims involved pension contributions under the ... trust agreement, ERISA and the Pension Protection Act of 2006. The District Court granted over $2 million in damages against the pension fund and we were successful in this appeal in overturning a majority of that award and having the case remanded to the District Court for further proceedings.

Represented the International Brotherhood of Teamsters in a matter before the Ninth Circuit Court of Appeals on a matter of first impression under the Railway Labor Act. I wrote the brief and argued th ... e case before the Court of Appeals in San Francisco. Case is published at 788 F.3d 1080 (9th Cir. 2015).

OUTCOME: Obtained judgment against over a dozen employers for unpaid fringe benefit contributions.

I represented several Taft-Hartley Trust Funds in a collection action against numerous contractors. The claims were made under NRS 608.150. We were successful in receiving a judgment against a dozen co ... ntractors for unpaid fringe benefit contribution on October 20, 2011. The case was Case No. 2:11-CV-779 JCM (LRL) before the U.S. District Court for the District of Nevada.
