An intoxicated victim of a sexual assault (fellow Soldier-Trainee) accused my Client of being her assailant. Prior to seeking my representation, my Client made several statements to law enforcement. Th ... ose statements marginally corroborated the alleged victim's recollection of the assault, but they served to provide the Government with all that it needed to move forward with a case against my Client. At the preliminary hearing, one member of the Government's counsel lost his good-faith belief (probable cause) in its case (he was replaced by another). Later, at trial, all of the unknowns were brought to light, our defense demonstrated the likelihood that the Government had the wrong Accused, and the Government's material fact witness (the third person in the room) was accurately portrayed as the assailant. *Approximately one year after the conclusion of this case, the third person in the room, who had moved onto a new duty statiuon, was convicted of a brutal first-degree murder.
