I represented the mother in this case where a custody order was in place and the parties cohabitated afterwards. When the father moved out, he tried to say that cohabitating was the same as receiving j ... oint physical care of the child & he should be treated as the joint physical custodian. The court found in favor of my client that she still had primary care and that giving extra parenting time with the child to the father did not change the order.
