Counsel for Petitioner sought to disqualify Napoli (and Beermann LLP) on the basis that an attorney at Beermann LLP served previously as a mediator between the parties. The trial court granted Petition ... er's Motion to Disqualify and Napoli and Beermann LLP appealed. The Appellate Court reversed the trial court (in favor of Napoli and Beermann LLP) and determined that Napoli and Beermann LLP's screening procedures "check all the boxes..." As such, Napoli and Beermann LLP were permitted to represent the Respondent.

OUTCOME: Appellate Court affirmed the circuit court's order granting husband's Motion to Enforce the Settlement Agreement and the circuit court's entry of the Judgment for Dissolution of Marriage.

Wife refused to sign the proposed judgment and Husband moved to enforce the judgment. Following a hearing on Husband's Motion to Enforce the Oral Settlement Agreement, the circuit court granted said mo ... tion and subsequently ordered the parties to prepare a judgment consistent with the terms the court previously found were orally agreed to. At the prove-up hearing, Wife testified that she did not enter into the oral settlement agreement freely and voluntarily. The circuit court rejected Wife's argument and entered the Judgment for Dissolution of Marriage. Wife appealed. Appellate Court affirmed the circuit court's order granting husband's Motion to Enforce the Settlement Agreement and the circuit court's entry of the Judgment for Dissolution of Marriage.
