A new day for an old rule. The old rule requires a DUI and a traffic ticket to be tried together. The Government ignored this rule that now applies because municipal court took over traffic court.

The Judge found that the trooper was not credible.

After she gets to the stat ... ion, her boyfriend dies. She wants to go to hospital but cops make her go to speak with homicide detectives. When they get to the detectives, they make her walk through a metal detector and find a gun. The cops talk to her about the shooting and then get her to admit the gun was hers. The Judge ruled that the police did not have the right to force her to go with them. Therefore, the gun they found and the statement they took were not admissible Without that evidence, the government had no proof she committed any crimes.

Officer claimed my client failed to stop at a stop sign. The officer said my client smelled like alcohol, had blood shot eyes, and trouble standing. My client told the COP he had three beers. My client ... s BAC was over a .160, the highest penalties. I made a motion to suppress the evidence because the cop did not have any reason to stop my client. My client said he stopped at the stop sign. During the motion, I questioned the cop. I got him to admit that, other than failing to stop, my client was driving fine. THe cop admitted that my client stopped at 3 previous stop signs, obeyed the speed limit, and pulled right over on signal. Then I asked about the failure to stop. I got the cop to admit that my client slowed down. But the cop insisted he didn't come to a complete stop. The judge did not believe the cop.
