All credit regarding this case and my involvement goes to the Honorable Court of Appeals Judge Robert C. Hunter and other members of the NC Court of Appeals involved in the decision. My involvement included legal research and the writing of a bench memo for Judge Hunter.

OUTCOME: No Error.

Robert Mitchell Foust (“defendant”) appealed from a judgment entered after a jury found him guilty of felony possession of cocaine. On appeal, defendant argueed that: (1) the trial court erred in fail ... ing to strike alleged hearsay testimony from the arresting officer; (2) the trial court erred in denying his motion to dismiss; (3) he was unfairly prejudiced by the ineffective assistance of his trial counsel; (4) the trial court erred by denying his motion to continue the trial; and (5) the trial court erred by sentencing him in the aggravated range, following trial in Superior Court for Alamance County on 21 January 2010. The Court of Appeals found no error. All credit regarding this case and my involvement goes to the Honorable Court of Appeals Judge Robert C. Hunter and other members of the NC Court of Appeals involved in the decision. My involvement included extensive legal research, the writing of a bench memo and the drafting of the opinion for Judge Hunter.
