This matter involved an individual who was injured while unloading products from his work truck at a client’s job site. Scott argued that the unlevelness of the defendant’s loading facility caused pla...intiff to fall while unloading products from his truck. The plaintiff injured his shoulder in the fall and required surgery. Liability was hotly contested.
This case was settled by Scott Bonebrake shortly before trial for the sum of $400,000.00.
Car accident
P.C. v PENNDOT et al
Jan 07, 2011
OUTCOME: $370,000 gross recovery
P.C. involved a motorcycle accident and was tried in front of a Delaware County jury by Scott Bonebrake. In P.C., the operator of a motorcycle and his passenger were injured when the motorcycle proceed...ed into an uncontrolled intersection and collided with a car. The intersection was uncontrolled for P.C., because the STOP sign which had been controlling his path of travel had been knocked down the previous evening, and not yet replaced by PennDot.
P.C. and his wife each sustained significant injuries. PennDot denied liability, claiming that they had no notice, either actual or constructive, that the STOP sign had been knocked down, and therefore could take no action. PennDot never offered any settlement amount prior to trial. Fortunately, a Delaware County jury found that PennDOT was responsible for not replacing the STOP sign in time, and awarded P.C. and his wife a significant amount of compensation, after a four day trial. Scott was also able to effectuate a favorable settlement with the driver of the vehicle that the Coluccis collided with.
