This case stems from a semi-truck versus semi-truck crash that occurred on Sept. 23, 2016. The cause of the crash was that a prior seller of one of the involved trucks had placed a 24-year-old, retread ... tire on the steer axle of the truck. Ultimately, that retread tire failed, causing the driver to lose control and crash into the plaintiff. The prior seller was named as the defendant by the plaintiff. Plaintiff’s counsel said they employed a novel theory of liability in order to establish liability against the defendant prior seller. The defendant’s insurer filed a declaratory action on the issue of coverage, arguing there was no insurable interest because the truck was sold prior to the crash.
