The cause of the crash was that a prior seller of one of the involved trucks had placed a 24-year-old, retread ... tire on the steer axle of the truck. Ultimately, that retread tire failed, causing the driver to lose control and crash into the plaintiff. The prior seller was named as the defendant by the plaintiff. Plaintiff’s counsel said they employed a novel theory of liability in order to establish liability against the defendant prior seller. The defendant’s insurer filed a declaratory action on the issue of coverage, arguing there was no insurable interest because the truck was sold prior to the crash. Plaintiff, age 56, was a patron at defendant’s bar. She and her father were in the process of trying to exit through the bar’s exterior door, leading to the sidewalk. Suddenly and without warning, ... defendant’s bouncer shot his arm out in front of plaintiff, to block her from leaving and to allow patrons to enter the bar. The force of his arm caused her to fall to the ground, fracturing her left elbow. Defendant’s primary defense was that “accidents happen,” and that this incident was not an example of negligent conduct on the part of defendant’s bouncer. Defendant also attempted to muddy the waters by arguing that plaintiff had many pre-existing conditions, and had a history of falls, for which she used a cane. Plaintiff’s counsel rejected a $75,000 case evaluation finding, preferring instead to move forward. After discovery was closed, an arbitration panel entered a unanimous arbitration award in the amount of $342,500, in favor of plaintiff and against defendant.

72-year-old plaintiff was walking down the aisle at a neighborhood big box store. Suddenly and without warning, the employee of an independent contractor — who was at the store because he was demonstra ... ting his products — was walking backwards, not paying attention to where he was going; the force of his backward movement knocked the plaintiff down. This caused her to sustain a hip fracture, ultimately resulting in a partial hip replacement. Defense counsel portrayed the incident as one not involving negligence, making the argument, in essence, that “accidents happen.” Also, defense counsel disputed plaintiff counsel’s assertion that the plaintiff had a very active pre-injury lifestyle. To counter that defense argument, plaintiff’s counsel submitted pre-injury photos and gym records, in addition to witnesses’ statements.
