Modification of Parenting Time
N/AOUTCOME: Client's Motion to Modify Parenting Time was granted by the Court following a contested hearing.
Represented Father in modification of parenting time proceedings. The parties had two young children. Following a contested hearing, the Court found that there were significant issues involving substan ... ce abuse, mental health and domestic violence in connection with Mother’s parenting time and that those issues were detrimental to the emotional and physical wellbeing of the parties’ minor children. The Court ordered that Mother’s parenting time be modified from equal parenting time to less than 75 parenting time overnights per year and, moving forward, all of Mother’s parenting time was conditioned on Mother demonstrating stability and sobriety. The Court also entered orders modifying child support as a result of the parenting time modification and Mother was ordered to pay Father child support pursuant to the Colorado child support guidelines.
