Plaintiff argued to the United States District Court of Idaho through response briefs and oral argument, opposing dismissal. The court awarded Plaintiff's argument, agreeing that Defendant's motion failed to fall under FRCP 12(b)(6). Ultimately, the parties the settled the claims privately.

Unum wrongfully denied Brandt's dependent life insurance benefits under an ERISA-governed policy, in which his late wife was the insured. Plaintiff, the would-be-beneficiary filed for benefits after hi ... s wife suffered a heart attack; Defendant denied the claim alleging that insurance was never effective because it claims she was disabled under the policy through a sustaining "life threatening condition" and coverage began once disability ended. Plaintiff had 8 years earlier been diagnosed with CAD, which Defendant claims caused her exclusion from coverage at the time the policy was in place before her death. The term "life threatening condition" included a definition as "critical," and Plaintiff argued to the court that the prior cardiac health complications and related issues present in the records did not constitute a "critical" condition; therefore, his wife did not have a "life threatening condition" that delayed the effective insurance. The court agreed with Plaintiff and awarded Plaintiff dependent life insurance benefits under the ERISA-governed policy.
