WON against former wife’s wrongful petition against husband-client for increased PROPERTY INTEREST
Jan 27, 2015OUTCOME: $72,000 more in client’s pocket in Settlement Agreement
Client’s former wife sought to force husband to sell marital home quickly during which time Ms. Trupiano successfully clarified the record and original Settlement Agreement that husband would only have ... to pay net sales proceeds and not gross sales proceeds of sale of house to former wife. This meant that former husband likely would have to pay former wife nothing at sale of marital home (not the $120,000 she envisioned upon sale of the house) unless there was the unlikely outcome that an actual profit after the original purchase price of the house is realized. (Case 124903574.) In the end, the parties settled, and Ms. Trupiano’s client paid $72,000 less in an amended Settlement Agreement then the former wife had originally wanted.
