OUTCOME: Probate will be avoided which was the desire of the client.

Elderly client owned a home outright and was worried about probate when passing her home to her children upon death. We prepared an Enhanced Life Estate (Lady Bird Deed) naming the children as remaind ... ermen. Upon the client's passing, the children will own the parent's home via the Deed, thereby avoiding the costs and delays of probate, as well as any claim by Medicaid for asset recovery if the parent was a Medicaid recipient.
