OUTCOME: Supreme Court ruled in favor of my client and he recovered his driving privileges that had been suspended for life.

Prior to this Supreme Court decision, drivers who drove while in Habitual Traffic Violator status were strictly liable even if prior cases could be set aside. The Oney decision helped carve out an ex ... ception to the law. I won at the trial court, was reversed on appeal and then my client won at the Indiana Supreme Court. OUTCOME: Court of Appeals affirmed the Trial Court

My client received a favorable ruling at the trial court. On appeal, the Court of Appeals granted my motion to dismiss the appeal. The Indiana Supreme Court heard oral argument which can be watched ... here: http://mycourts.in.gov/arguments/default.aspx?id=1369&view=detail. The Supreme Court ordered the Court of Appeals to rehear the merits of the case which they did and ruled again in my client's favor.
