Appeal of conviction for healthcare fraud. A federal grand jury indicted Steven DeLia on one count of healthcare fraud. But the government filed the indictment outside the ordinarily applicable statut ... e of limitations. Notwithstanding this filing, the government argued the indictment was timely because: (1) the Wartime Suspension of Limitations Act suspended the limitations period from running in this case; and (2) DeLia waived his asserted statute-of-limitations defense. The Tenth Circuit rejected both reasons and concluded the prosecution was time-barred. DeLia’s conviction was vacated and the indictment was dismissed.

SECURITIES FRAUD CHARGES. Client charged in federal court with 106 counts of forged securities and money laundering in the downfall of the Orienta Coop. Defense counsel argued that Mr. Hunt used his ... true and correct name on all checks (which were considered securities) when making investments in the Coop's account. Accordingly, there were no forged securities and, thus, no money laundering. All counts reversed for insufficiency of evidence with orders to enter an acquittal on all counts.

HEALTHCARE FRAUD CHARGES. Two doctors accused of multiple counts of mail fraud involving CHAMPUS Insurance. At trial and on appeal, it was argued that the doctors committed no fraud because the speci ... fically identified the surgical procedures performed. The insurance company complained that the medical term used didn't adequately identify the procedure. The Tenth Circuit Court of Appeals found insufficient evidence for conviction and remanded with orders to enter an acquittal on all counts.
