After a series of delays, the court found that defendant failed to participate in discovery frustrating plaintiffs ability to examine defendant’s purported defense that she suffered a black out or lost consciousness. These procedural gaffes ultimately won plaintiffs summary judgment as to liability and the court granting plaintiffs’ motion to compel defendant to produce financial discovery relating to the punitive damages claim.
