Child Abuse by Injury Dismissed

Client was looking at the possibility of life imprisonment after being charged with child abuse by injury. At the preliminary gearing, was able to get the State's medical expert to admit that blood te ... sting on the child performed months earlier showed results that could cause the child to bruise more easily than normal. Was able to get the State's officer witness to admit on cross-examination that prior to the child’s examination the child had been out of the county for days, thereby questioning the jurisdiction of the court, since the alleged injuries could have occurred in another county. Was able to prevent the State from admitting child hearing statements. At the end of the State's case at preliminary hearing, the Court granted the defendant’s demurrer and dismissed all charges.
