Plaintiff was being transported from the hospital to her home in a van owned and operated by MHC. During transport, Plaintiff was ejected from her wheelchair when a phantom driver pulled out of a shopp ... ing center directly in front of the MHC van. Plaintiff suffered an injury to her lower extremity. Plaintiff claimed MHC and its employee failed to properly secure her. MHC asserted that Plaintiff undid her restraints prior to the accident.
