However, the officer told my client he could not make long distance called from the jail. My client did not have his cell phone because the officer did not allow my client to have it. Leaving the Scene of an Accident (Mesa) - Dismissed - 8/15/2017 A dismissal is rare in the City of Mesa. Cases never get dismissed in this court. However, I found some issues with my client's case. Fi ... rst of all, it was old. When my client hired me he just learned there was a warrant out for his arrest. He only learned of the bench warrant for a failure to appear when his employer did a random background check. I was called and immediacy filed a motion to quash the warrant in the City of Mesa Municipal Court for Leaving the Scene of an Accident. During the investigation, it was learned that my client never received a summons to appear in court. The Mesa officer investigated the case and learned he no longer lived at his last known address. Despite knowing this, the officer still listed the old and wrong address as my client's current place of residence, and the summons was mailed to that address. Obviously my client did not receive the notice and a warrant was issued for his arrest when he did not appear in court. The officer was in possession of additional information showing he was in Oregon at the time. I took this information to the prosecutor and we worked out a deal - If my client completes 10 hours of community service his case would be dismissed. 10 hours were finished and the Leaving the Scene of an Accident was dismissed.
