Mother was accused of abuse and neglect and her children were removed from her home. The Department moved for severance for all children. After a contested severance trial, Ms. Castillo successfully ... argued that the Department had not met its burden of providing services to Mother despite the time the children had been out of the home. The Department was required to provide additional services to mother and change the case plan from severance to reunification.

OUTCOME: RF was acquitted of the aggravated assault and the lesser included offense of disorderly conduct with a deadly weapon. RF was only found guilty of the least serious assault, a class 1 misdemeanor.

OUTCOME: Not Guilty All Counts

Officers were watching a house. Officers witnessed a vehicle leaving the driveway of the house and stopped the vehicle. Officers identified the driver as JC and after a brief investigation and a searc ... h of his bag, released him. Officers then went back to same house and claimed that they smelled marijuana coming through a quarter inch crack in the front window. A Commissioner issued a warrant and officers entered the house and found approximately 30 pounds of marijuana, along with guns and a scale. Officers located indicia from the house that supported the residency of JC at the house searched. Latent prints were taken from the evidence seized but no prints identified JC and others positively excluded JC. One print returned with the identity of another. After a Superior Court Judge denied JC’s motion to suppress based on an illegal search of the house, Mr. JC proceeded to trial. After nine days of trial, Ms. Castillo was able to persuade the jury that the officers’ testimony was not credible; that mere presence did not support a conviction and that the officers’ investigation was incomplete and the prosecution had disregarded key evidence. The jury acquitted Mr. JC on all charges in approximately 2 hours. If convicted, Mr. JC could have faced up to 28 years in prison.

SM was charged with disorderly conduct, criminal damage, and assault. At trial, I argued victim was first aggressor and SM acted in self defense. Judge found her not guilty on disorderly conduct and ... criminal damage but convicted on assault. After client appealed, the Superior Court reversed the conviction stating the State had not met their burden on Assault and Judge should have granted my motion for judgment of acquittal.

The jury found Mr. ED not guilty on the impairment charge and hu ... ng on the BAC charge. After the case was set to trial two additional times, the State finally dismissed the charge completely.
