Summary of Facts: Janis Merrell was visiting the R&S Mattress Liquidators store in Mesa, Ariz. Merrell was reportedly in the back lot with an R&S salesperson who proceeded to pull out a mattress for h ... er and yelled “watch out.” Janis fell backwards over a mattress fracturing her left hand and wrist. Janis filed suit alleging defendants negligently failed to keep safe premises. Janis sought judgment for serious and permanent personal injuries to her left wrist, disability, disfigurement, and pain and suffering. Her medical bills were in excess of $69,063.43. A jury convened before Judge John Rea and (rightfully) returned a verdict May 10, 2011 for the plaintiff in the amount of $209,000. The panel found R&S Mattress Liquidators 80 percent at fault. Judge Rea entered judgment for the plaintiff Janis Merrell in the amount of $167,200 plus costs.
