AMEX v. Sisler
N/AOUTCOME: The jury determined that AMEX Assurance Company breached the homeowner's insurance contract and comitted bad faith resulting in a verdict in favor of Mr. Sisler
Allen Sisler and Thomas Erhardt were shot in the head by David Smokoska, who then took his own life. The victims sought homeowner's insurance coverage from the shooter's insurer, AMEX Assurance Compan ... y, which was denied. AMEX Assurance Company then sued the victims and the homeowner asserting that there was no coverage for the shooting. Mr. Sisler obtained an assignment of rights and a stipulated judgment in the amount of $1,000,000.00 from the homeowner and counter-sued the insurer for breach of contract and bad faith.
