I wrote the appellate brief in this case. In this case, the plaintiff, Ms. Bloch criticized the elected sheriff of Medina County, Ohio, indicating displeasure in the way that his office investigated a ... rape case. The sheriff responded by releasing embarassing information about the rape itself. We successfully argued that his release of information was in retaliation for her criticisms and thus chilled her First Amendment Right to Criticize elected officials. Secondly, the case created a new constitutional right to privacy when certain private sexual matters are involved. This case has been cited hundreds of times over the years as a precedent.
