Represented Defendant on appeal in case of first impression to the Arizona Court of Appeals. Plaintiff sought to obtain a deficiency judgment for the balance due following the Trustee Sale of Defendant ... ’s primary residence. Plaintiff obtained summary judgment in the Maricopa County Superior Court Action. On appeal, Defendant successfully argued that the anti-deficiency protections afforded by Arizona Revised Statutes (A.R.S.) section 33–814(G) (Supp. 2012) may not be prospectively waived by the purchaser as such protections represent an important public policy.
