OUTCOME: Not Guilty A1, A2, Extreme and Super Extreme

Client was in two separate car accidents that eventually rendered his vehicle inoperable. One single police officer arrived hours later to the scene. He did not attempt to get an interpreter for my c ... lient nor did he photograph scene or interview the witnesses all mostly Spanish speaking. Client's blood drawn 4 hours later which the State testified that at the time of driving, client had to have been over a .40! A dose of alcohol that can put a person in a coma. Since the entire 4 hours my client displayed no balance problems, was not tired, sleepy or fatigued, it was difficult to believe a person that high could maintain alertness. The main "seasoned" officer disobeyed the judge multiple times while on the stand and ultimately looked so unprofessional the jury hated him. The jury understood the standard of reasonable doubt.

The jury hung on all counts including extreme DUI. Scottsdale had blood results AND a breath test and still the jury did not believe the results.

Client was a .13 according to the lab. Once we received the records it was shown the control used in the run was in error by 39%! Also the criminalist made 9 errors in the samples which had to be re- ... run. The HGN officer only saw 2 cues out of 6. Upon a Rule 20 for failing to prove driving, the client was acquitted.
