Synopsis Background: Wife brought divor ... ce action, and husband counterclaimed for a divorce. The Circuit Court, Morgan County, No. DR–09–900018, Sherrie W. Paler, J., entered judgment awarding physical custody of one child to wife and physical custody of the other child to husband. Wife appealed. Holding: The Court of Civil Appeals, Thomas, J., held that evidence was insufficient to conclude that custody order separating siblings was in children's best interest. Reversed and remanded.
