OUTCOME: Not Guilty

Client, a 23-year-old young man, was charged with Rape after an alleged incident at a local College. Client was accused of raping his friend’s sleeping girlfriend during the early morning hours after ... a night of drinking. He allegedly went into the friend’s room, where the friend’s girlfriend was sleeping, and put his hands down her pants and inserted his fingers into her vagina. Client’s mom hired Attorney Joseph B Simons a day after Client was arrested. Over the next year and a half, Attorney Simons filed several motions and appeared in court over a dozen times. Finally, trial came. After a four day trial, the jury came back with a verdict of Not Guilty. As a result, Client avoids a significant prison sentence, as well as registration on the Sex Offender Registry, and walks out a free man.

Client, an 18-year-old high school student, was charged with Assault and Battery with a Dangerous Weapon (Knife) and Domestic Assault and Battery on a Household or Family Member. Client was accused of ... slapping her 16-year-old girlfriend in the face, and then cutting her with a knife across her face several times. During a police interrogation, Client admitted to the conduct. Facing very serious charges, Client hired Attorney Joseph B Simons. Client, a 25-year-old man, was charged with Assault and Battery on a Family or Household Member, Disorderly Conduct, and Assault and Battery. Boston Police alleged that Client went up to his ex-girlfr ... iend in a bar and punched her in the face so hard that she fell to the ground. Afterward, Client allegedly went outside, caused a scene, and pushed a bouncer, while calling him a “useless nigger.” Client hired Attorney Joseph B Simons to fight the case. At Client’s first court appearance, the prosecutor requested the judge to hold him without bail as a bail revocation, given that Client had four other cases throughout the state. Fortunately for Client, the judge sided with Attorney Simons and Client was released. On the day of trial, and over the prosecutor’s objection, the case was dismissed.

OUTCOME: All Felonies Dismissed, No Jail Time for Client

Client, a 25-year-old apprentice plumber and father, was indicted for Armed Home Invasion, Malicious Destruction of Property over $250, and Assault and Battery with a Dangerous Weapon. All charges are ... serious felonies carrying state prison time, with the Armed Home Invasion threatening a 20-year minimum and up to a life sentence. For a year-and-a-half, Client was represented by another attorney. At a certain point, that attorney suggested a plea involving almost two years in jail. After losing confidence in his prior counsel, Client hired Attorney Joseph B Simons. Within a month or two on the case, Attorney Simons convinced the prosecutor to come way down on her recommendation, with a 15-month sentence. Nonetheless, Client elected to continue the fight toward trial. Finally, a week before the trial is scheduled to begin, Attorney Simons convinced the prosecutor to drop all the charges, except for a reduced simple assault and battery. Attorney Simons further convinced the judge to sentence Client to probation ad thus, avoiding any felony conviction or jail time.

Client, a 28-year-old single mother from Ohio, was accused of Identity Fraud and Credit Card Fraud after her ex-boyfriend accused her of opening up credit cards in his name. Client, a 25-year old pharmacy doctoral candidate, was accused of Malicious Destruction of Property Over $250, after allegedly smashing up two vehicles with cinder blocks in the middle of the night wit ... h a friend of his. Clients hired Attorney Joseph B Simons, who investigated the case, spoke with the victims, and prepared the case for hearing. Boston Police and Northeastern University Police were involved. Both departments were pushing for the charge to go forward, as officers also accused Client of yelling, swearing and generally being belligerent to them. To make matters worse, Client had a history of alcohol-fueled incidents with campus police. In between the incident and the hearing, Client took the first steps toward confronting his alcohol dependence, and had already paid a stiff penalty by way of a two-year suspension from grad school, just months before graduation. Today, at the hearing, Attorney Simons persuaded the clerk magistrate to hold open the case. As a result, if Client remains out of trouble for one year, the case will be dismissed and never appear on his record.
