Possession with Intent to Resell More than 0.5 grams of Cocaine - Class B Felony
Jan 11, 2013OUTCOME: Plea Bargain: Reduced Charge, Sentence; Probation; Minimum Fine
My client was charged with Class B Felony Possession with Intent to Resell More than 0.5 grams of Cocaine (TCA § 39-17-417(c)), which carries a maximum sentence of 12 years imprisonment in the state pe ... nitentiary (TCA § 40-35-112) and a maximum fine of $100,000.00 (TCA § 39-17-417(c)(1)). Through negotiations with the District Attorney, I was able to secure a plea bargain agreement under which my client received a $2,000.00 fine (the statutory minimum) and three years of probation. Additionally, because my client was attempting to secure employment with a contractor in the Middle East, the Court permitted my client's probation to be unsupervised during the verifiable period of any contract for employment with an overseas contractor, allowing my client to pursue his legitimate career opportunities unimpeded by his probation. In exchange, my client plead guilty to the reduced charge of Possession with Intent to Resell Less than 0.5 grams of Cocaine, a Class B Felony.
