Often, entrepreneurs apply for federal trademarks without using an attorney, or by using an non-attorney online website. The frustration happens if the Trademark Office's Examining Attorney issues a de ... nial in an office action. That's when entrepreneurs usually seek an attorney's help. In one case I assisted a magazine in overcoming such an office action in which the examining attorney asserted that the name of the magazine was merely a surname. With a little internet research and a convincing argument, the examining attorney agreed to let the application proceed.
