Melissa Davis, a 25 year old bartender and mother of a young child, was in the parking lot of the Lone Star Oyster Bar on 34th Street in Lubbock when she was run over by a vehicle owned by a major midw ... est communication company and operated by one of its employees. Melissa received severe bruising, which turned into a severe staph infection, requiring extensive hospitalization and lengthy recovery time. Discovery revealed that the driver, who was arrested for DWI at the scene of the accident, had a prior history of alcohol related incidents, and that the company was aware of this but hired him anyway. We were proud to be able to have a such a great result for this young woman and her child.

Vanderdussen registered .13 on a preliminary breath test that was conducted, but failed to complete the formal breathalyzer. Vanderdussen, although a minor, had also posted extensively on Facebook with photos and comments concerning her drinking escapades.

On October 18, 2003, Plaintiff Christopher Martin, age 2, was a passenger in a Kia Rio driving westbound on 4th Street in Hale Center, Texas, with his mother and stepfather, great-grandmother and cous ... ins. As the vehicle crossed the railroad grade crossing at 4th Street, they were hit by a southbound freight train operated by BNSF Railway Company. The crossing had no gates or flashing lights, and witnesses testified that the freight train failed to blow its horn as it approached the crossing. Killed were Shatarica Martin (19), Denatzhia Moses (18 mos.), Jean Johnson (71). Christopher and his cousin, Natasha Johnson (11) received severe injuries.
