Debbie Burton v. Kenny Patel dba Days Inn and Suites Downtown, Sevier County Circuit Court No. 16-CV-799-IV
Mar 29, 2017OUTCOME: Settled prior to trial
I represented the Plaintiff in this negligence action against a local motel. The Plaintiff was injured when she slipped and fell in the bathroom of her motel room. The Plaintiff broke her right leg. Th ... e defendant failed to maintain the hotel restroom in a safe condition to prevent guests such as the Plaintiff from being injured. Specifically, the Defendant was negligent in that the bathmat placed in the bathtub was not properly secured by the Defendant and/or the Defendant’s employees prior to the Plaintiff’s use of the bathtub. The bathtub was not equipped with a safety bar or any reasonable support feature to assist guests when entering and exiting the bathtub. The bathtub was not equipped with a slip resistant surface. There was a residue on the bathtub surface which caused it to be dangerously and abnormally slick. Through research I learned that the Defendant had a long history of safety complaints from previous guests. Luckily, in this instance the Plaintiff received excellent medical care and made a complete recovery. I obtained a favorable settlement of $51,000.00 for the Plaintiff's past pain and suffering and related medical bills.
