Vietnam-era veteran was involuntary hospitalized by the lower Court due to a likelihood of property damage and financial loss that would occur if he was not hospitalized against his will. Legal issue ... presented on appeal was whether property damage and financial loss should be considered as factors under the Tennessee involuntary hospitalization statute. The Court of Appeals ruled that property damage and financial loss are not to be considered as factors under Tennessee law and ordered client to be released from the unconstitutional confinement he was forced to endure for almost one year and possibly for the rest of his life.
