OUTCOME: Unanimous defense verdict on all claims

Sheston Law Group, PLLC secured a unanimous defense jury verdict on all claims on March 15, 2024, in an aspiration/wrongful death case that was tried in the First Judicial District, County of Santa Fe, ... NM. After a week of evidence presentation and witness testimony, the jury deliberated for only 39 minutes before reaching a unanimous decision in favor of the defense. In closing arguments, Plaintiff suggested the jury should award in excess of $300 million dollars in damages. Punitive damages were sought the went to the jury. Trial attorney, Paul J. Paul J. Sheston, of The Checkett Law Firm, PLLC in Scottsdale, Arizona, secured a unanimous defense verdict on all claims against a national plaintiff’s firm following a two-week jury trial in Navajo C ... ounty Superior Court re elder abuse/neglect and medical negligence claims brought by family of deceased female resident regarding care and treatment provided during a four and a half year admission to a skilled nursing facility in Navajo County Arizona. Decedent suffered numerous pathologic fragility fratures in her spine, hip, ankle, foot, ribs, wrist, and humerus as a result of her extremely severe advanced osteoporosis. Plaintiff asked the jury in closing for $1M in damages. Jury returned unanimous verdict after 90 minutes of deliberation in favor of defense on all claims.

OUTCOME: Defense verdict on all claims - unanimous

Paul J. Sheston, of The Checkett Law Firm, PLLC in Scottsdale, Arizona, secured a unanimous defense verdict on all claims against a national plaintiff’s firm following a seven-day jury trial in Navajo ... County Superior Court. The seven surviving statutory plaintiffs sought compensatory and punitive damages for wrongful death and alleged abuse and neglect under the Arizona Adult Protective Services Act against an Arizona licensed skilled nursing facility in relation to an elderly WWII veteran who developed chronic subdural hematomas secondary to falls. The ten member jury panel found that the defendant facility did not abuse or neglect the decedent during the nine month admission to the facility, and found that the staff’s care and treatment of the decedent was not the proximate cause of his death following a fall with subsequent brain bleed and unsuccessful craniotomy. Plaintiffs asked the jury for $7M in wrongful death damages, as well as medical special damages, pre-death pain and suffering, loss of life, and punitive damages.

Plaintiff brought claims of negligence, violation of the Arizona Adult Protective Services Act, A.R.S. 46-451 et seq. and sought punitive damages against skilled nursing facility related to the 7+ year ... admission of a catastrophically brain injured and bed bound Plaintiff who developed a chronic non-healing Stage IV pressure wound which required surgical flap closure. Plaintiff's last demand before arbitration was $1M dollars. After a four-day binding arbitration hearing, retired Judge/ appointed arbitrator found in favor of Defendants on all claims.

Published decision by the Arizona Court of Appeals, Division One, which granted special action jurisdiction and reversed a trial court order requiring defendants to produce all documents generated by, ... or at the request of, a nursing home quality assurance committee. In an issue of first impression in Arizona, the Court of Appeals held that certain QA documents, including detailed tables and graphs created by the QA committee for the purpose of improving quality are subject to the federal quality assurance privilege applicable to skilled nursing facilities (42 U.S.C. 1396r(b)(1)(B)) and are therefore not discoverable.

OUTCOME: Defense verdict

Trial attorneys, John J. Checkett and Paul J. Sheston, of The Checkett Law Firm, PLLC in Scottsdale, Arizona, secured a unanimous verdict for the defense in a jury trial against a national plaintiff’s ... firm. The plaintiffs alleged claims for wrongful death and violations of the Arizona Adult Protective Services Act against a skilled nursing facility. Following a two-week jury trial in Maricopa County Superior Court (Dimperio v. Sun City Health & Rehabilitation, et al., CV2011-007286) before the Honorable Michael Herrod, the jury returned a unanimous verdict in favor of the defendant on all counts, and found that the defendant did not breach the standard of care in providing skilled nursing care to a 77-year-old resident who suffered spontaneous pathologic fractures in her hip and shoulder during an unforeseeable grand mal seizure. The jury deliberated for an hour and a half before delivering their verdict in favor of the defense on all claims.
