In re Estate of Skinner, 417 S.W.3d 639
Oct 15, 2013OUTCOME: Reversed and remanded
Represented the ex-wife of a decedent who was also the named beneficiary of the decedent's life insurance policy. The ex-wife and decedent had been divorced three years previosuly and she had been div ... ested of her interest in the policy in the divorce decree, but the beneficiary designation had never been changed on the policy. When the ex-wife received the life insruance proceeds after the decedent's death the administrator of decedent's estate applied to the probate court for a temporary injunction. The ex-wife was ordered to deposit the funds from the insurance policy into the court's registry. On appeal, the appellate court held that it had jurisdiction to review an order granting a temporary injunction, and that the temporary injunction was void for failure to set a date for trial on the merits and for failure to set a bond.
