The Department of Corrections wrongfully discharged Greer early from supervision due to an error made by DOC employees. The error was caught almost three years after the discharge was given. Greer wa ... s taken into custody and proceedings were started to revoke his supervision for conduct he engaged in during the time period he was not being supervised and had been told he was discharged. A revocation hearing was held and he was revoked. An administrative appeal was unsuccessful so a writ of certiorari was pursued in Racine County Circuit Court. The writ was successful and the decision to revoke his supervision was overturned. This decision was appealed by the DOC and the Wisconsin Court of Appeals overturned the decision of the writ of certiorari court judge, reinstating the revocation. A Petition for Review was filed with the Wisconsin Supreme Court and was accepted. The case was heard at oral argument before the Wisconsin Supreme Court on October 22, 2013. A decision is still pending.
