Family Trying to Cut Out Beneficiary
N/AOUTCOME: Successful settlement payment to my client
My client was a child of a direct heir of an estate. Though my client was not himself a direct heir, he was named as a beneficiary of a trust. However, the heirs tried to ignore the trust. When we pres ... sed the issue they tried to have the trust found invalid. If successful, they would have effectively disinherited my client (and the other trust beneficiaries) and collected all of the estate themselves. They made an initial offer to my client of a very small sum. I suggested that we turn down the offer, as I felt our case was strong. The case lasted nearly 2 years and ended up scheduled for trial. On the day of trial, the opposing party offered my client a very substantial cash settlement, which he was thrilled to accept.
