OUTCOME: DWI & Refusal reduced to Reckless!
My client did well enough on the field sobriety tests to create some doubt in the prosecutor. I turned this doubt into a Reckless driving charge.
OUTCOME: DUI-D reduced to Reckless Driving!
This was a DWI based on prescription medications. The prosecutor said the levels were high - the expert agreed with me that the levels were low therapeutic.
OUTCOME: DWI reduced to Reckless & no license suspension
There was a problem with the roadblock plan. A DWI became a reckless driving with no jail and no license suspension.
OUTCOME: Ignition interlock violation - Dismissed!
I demonstrated that the breath alcohol elimination rate was physiologically impossible.
OUTCOME: DUI-D Deferred for Dismissal!
A plea deal was reached to defer this DUI for dismissal when sufficient doubt was created over whether the blood test could be used.
OUTCOME: Hold removed from license
The Virginia Department of Motor Vehicles indefinitely suspended the client's license though the prior DWIs were out of state. I showed the DUI laws were not substantially similar.
OUTCOME: ASAP Violation - deferred for dimissal!
He represented himself for a DWI 1st, listened to the prosecutor, and agreed to 8 days in jail! No one talked to him about ASAP.
OUTCOME: DWI - Not Guilty!
DWI 1st. I excluded the breath test and beat the officer on field sobriety tests.
OUTCOME: Driving Revoked - Dismissed!
The prosecutor was not able to prove the case resulting in a Nolle Prosequi
