This failure to provide medical care (or to evaluate the patient and ensure the patient is stable) ... is unlawful under federal law, specifically the Emergency Medical Treatment and Labor Act (EMTALA). Luckily the baby was delivered safely and the mother was unharmed during the process from a medical standpoint; however, the violation by the hospital resulted in my firm asserting a claim. The matter was eventually settled.
