This matter involved Mr. Doe being involved in a severe motor vehicle crash when the van in which he was a passenger rolled over, throwing him from the vehicle. He suffered a major traumatic brain inj ... ury and his wife and three minor children will never again know the husband and father they had always known before. The van was owned by an employer which made the matter a very complex combination of Florida's workers' compensation laws and tort law. After the workers' compensation carrier initially denied benefits, we argued that they had waived their right to immunity under Florida's workers' comp laws and filed suit in Circuit Court. After a nearly four year battle, involving two different employers, four different insurance companies, and three different total lawsuits, we were able to secure a settlement that will make sure that Mr. Doe has all of the care he needs for the rest of his life and that his wife and children will be secure for theirs.
