OUTCOME: Case dismissed

HN was charged with a violation of Penal Code section 330, illegal gambling. The charge stemmed from an undercover investigation by the Oakland Police Department that culminated in the raid of an inter ... net cafe suspected of hosting illegal slot machines. There were numerous individuals arrested on suspicion of operating the gambling facility, including H.N. Jeremy prepared her defense for trial, and was prepared to argue that N.H. lacked the necessary knowledge to be proven guilty of the crime. The District Attorney dismissed the case against N.H. on the date of trial and proceeded to prosecute another individual.

OUTCOME: Non-CLETS restraining order granted

LP applied for a restraining order against GM, her former partner and the father of her two young children, for showing up in the middle of the night, intoxicated, banging on her front door, yelling, a ... nd slashing the tires of LP's male visitor's truck. Mr. Forsyth represented GM in order to prevent the restraining order from being granted, because this creates a presumption in a child custody action, under the California Family Code, that the restrained parent is a potential danger. Mr. Forsyth was able to negotiate with LP in order to prevent a formal restraining order from being granted, and instead to agree to a "non-CLETS" restraining order. The order was essentially a written agreement between the parties that could be enforced by the court if one party filed a formal complaint with the court, but could not be enforced by law enforcement, thus saving GM from being subjected to action by law enforcement in the event he violated any terms of the agreement.

OUTCOME: Motion granted

SL was arrested and charged with domestic violence on his spouse. His trial attorney negotiated a dismissal in exchange for SL completing 10 hours of anger management classes. SL completed the classes, ... and the case was dismissed as the DA promised. SL later hired Jeremy to attempt to seal and destroy the record of his arrest and charges. Jeremy prepared a successful motion by interviewing the victim, obtaining detailed declarations, and providing documentation in support of the assertion that the victim had been drunk during the time of the interview with police following the alleged battery. The petition was granted, and SL's criminal history was cleared of the arrest and charges.

OUTCOME: Dismissal.

T.B. was charged with vandalism after getting into an altercation with her ex-boyfriend's new girlfriend. She was alleged of accosting the woman while the woman was in her car outside the ex-boyfriend' ... s residence, and smashing the car with a golf club, T.B. was adamant that the woman made up a story about her in order to erase any remaining sentimental feelings the boyfriend may have had towards her, and she was prepared to testify at trial. Mr. Forsyth prepared the case for trial, but the District Attorney dismissed the case on the day trial was to commence.

OUTCOME: Acquitted of all counts

JY was charged with domestic battery on his former spouse and mother of his child. The case ended up going to trial as JY insisted on his innocence. The alleged victim took the stand for the prosecutio ... n, as did the police officers who responded to the scene on the night of the altercation, as well as the detective who followed up with the victim. JY took the stand to testify in his own defense, and that, coupled with the introduction of phone records that contradicted the alleged victim's account of the altercation, convinced the jury to acquit JY after two days of deliberation.

OUTCOME: Case dismissed

F.M. was a scrappy man with a bushy gray beard, pushing middle aged life, living in a residential hotel in Hayward, CA. He was probably 5'5" and 120 lbs. F.M. had a special love and passion for mid-1 ... 950's bicycles, and kept bicycle tools near the foot of his bed. He was accused of threatening a frequent visitor of the hotel, a 6'4" man weighing 230 lbs., with a metal pipe and a knife. As F.M. was already on probation, the district attorney chose to dismiss the new assault case and punish the conduct through a petition to revoke probation and thereby punish F.M. for the incident. A bench trial for the petition to revoke was set. On the date of the trial, all of the witnesses showed up to court, including the wispy F.M. and the musclebound 6'4" victim. The case was dismissed at the request of the district attorney.

OUTCOME: Deferred prosecution

V.K. was charged with three counts of Penal Code Section 647(f), Public Intoxication. She was charged with three counts because she was found blacked out in public on three separate occasions, essenti ... ally passed out or unable to walk. Penal Code Section 647(f) says that a person may not be intoxicated in public if they are unable to exercise care for their safety or the safety of others. In this case, V.K. was unable to exercise care for her own safety, and that is why the officers arrested her and the district attorney charged her with violating the law. V.K. had a long-documented case of mental illness, including anxiety. Her anxiety manifested itself obviously in court. But it was also apparent that V.K. fought hard in her struggle to care for herself. She attended support groups and therapy sessions with psychologists on a regular basis, and it was obvious that her drinking was merely a coping mechanism that she could not easily control. It all came down, then, to intent. Whether her actions were willful under the meaning of the law would have been a factual question for the jury. As it turned out, the district attorney did not want to see the case get to a jury and offered a deferred prosecution, which meant that the case would be dismissed by the district attorney eighteen months after the filling of formal charges, provided that V.K. did not pick up any additional criminal cases. V.K.'s case was dismissed.
