The Court of Appeals held that: (1) record did not support jury's failure to award any damages for father's pain and suffering; (2) grant of new trial with respect to pain and suffering claim did not require new trial with respect to all claims; (3) fault was properly apportioned against third-party defendants who were dismissed prior to trial on grounds independent of their liability to plaintiffs; and (4) Kentucky law, rather than Ohio law, governed action.
