Rather than pay a reduced sum to settle the claim brought against County by F ... irst American, the errors and omissions carrier for County sought to pass the blame off to certain third parties it joined to the litigation. First American had warned the carrier that if it did not settle the claim, First American would pursue the matter through trial and would seek not only the monies it paid to settle the underlying claim, but also all of its attorney's fees and costs under the terms of the Agency Agreement between First American and County Abstract. The carrier did not heed the warning and the matter was tried at a bench trial. After trial, the Court awarded First American a judgment for the full amount paid to settle the underlying claim, as well as all attorney's fees and costs incurred by First American through the trial. The Court also awarded First Amerian interest on the sum of money it paid to settle the underlying claim.

The relief obtained in this case changed the manner in which documents were recorded in the Philadelphia Department of Records and was a major victory for the title industry in that it could more reasonably rely on the state of the recording records in Philadelphia after this relief was obtained.

Mr. Rood brought a claim under his title insurance policy alleging that Commonwealth Land Title was responsible for the cost of removing an abandoned septic tank on his property. A sink hole had deve ... loped on a neighbor's property as a result of the existence of a similar septic tank. Mr. Rood contended that Commonwealth had liability for the tank as a result of reference to the tank in the records of the local municipality. He sought relief for himself as well as a class of individuals who he contended were sold policies by Commonwealth based on allegedly inadequate searches of the public records. We moved for summary judgment on the basis that the claims asserted by Mr. Rood were not covered under a title insurance policy. The lower court agreed and granted summary judgment holding that a title insurance policy does not provide protection for physical defects in property, only matters affecting the title to the property. The decision was upehld on appeal by the Superior Court and a Petition for Allowance of Appeal to the Supreme Court was denied. The case is an important case in analyzing the scope of coverage provided under a title insurance policy in Pennsylvania.
