May 13, 2013OUTCOME: SJC affirmed, holding that a doctor, other than a mental health professional, owes no duty to a third person arising from any special relationship between the doctor and patient; and that no duty exists under ordinary principles of negligence.
Plaintiff appealed a Superior Court decision that the Defendant physician does not owe a duty to nonpatients to warn his or her patients of the dangers of driving posed by a patient's underlying medica ... l condition (in this case, epileptic seizures). Medina's Application for Direct Appellate Review was granted by the SJC.
