In September 2011, Mr. Gwaro was driving on I-81 through Lebanon County when he was stopped for speeding by a PA State Police Corporal. The Corporal cited Mr. Gwaro and told him he was free to leave. ... Mr. Gwaro attempted to drive away, but the Corporal re-approached him and asked him about the car’s rental agreement. When Mr. Gwaro explained that the agreement was current and valid but not in the car, the trooper decided to search the vehicle. Joined by another trooper, the Corporal then searched Mr. Gwaro’s car and, subsequently, charged him with Access Device Fraud. On Mr. Gwaro’s behalf, we filed a suppression motion in the Court of Common Pleas arguing that the search violated Mr. Gwaro’s Fourth Amendment rights. At the suppression hearing, the Commonwealth conceded the motion and dropped the charges against Mr. Gwaro.
