Appeal to 8th District Court of Appeals to determine if home owners / consumers have any right to make claims against a contractor's bond.
OUTCOME: Defense verdict - for my client
Plaintiff sued Defendant for alleged damage to house from pesticide product. I represented Defendant. Plaintiff stated he did "not know" what was on his house, looked like pre-existing paint damage.
OUTCOME: Full judgment for consumer client
Construction contractor failed to complete work or do work in a good and workmanlike manner, and committed numerous consumer law violations. Damages were almost a quarter of a million dollars.
OUTCOME: The judgment was affirmed and even modified in favor of Dan's client. New law was established in the 11th District, as a result of Dan's arguments.
Dan represented a contractor in defending a judgment rendered in their favor at the trial court level. Dan's client wanted to have the lower court decision affirmed.
OUTCOME: The case was settled for substantially more than the value of the service plan.
Client purchased an engagement ring and service plan from Alvin's Jewelers (now out of business). While Alvin's was going out of business, it refused to comply with the requirements of the service pla ... n agreement, among other things.
OUTCOME: Settled - $5 million plus other relief for the class
