Plaintiff was traveling through Kentucky on her way from her home in Georgia to visit her daughter in Indiana. While traveling in Kentucky, she had car troubles - a flat tire. The police responded & ... helped Plaintiff change the tire & put the spare on. After doing so, the police instructed her not to exceed 40 miles per hour on the expressway while using the donut tire. While following the officer's advice not to exceed 40 miles per hour, Plaintiff was rear-ended from behind at a high speed by an inattentive driver. Plaintiff sustained a brain injury which interfered with her ability to recollect many details. Mr. Erpenbeck was contacted several days after the wreck. He immediately launched an investigation into the facts of the accident and hired an engineer to inspect the vehicles involved in the wreck, download the black box data, and reconstruct the accident. The inattentive driver stated that Mr. Erpenbeck's client was completely stopped in the highway with no lights on. Mr. Erpenbeck's client sustained a brain injury that made it difficult for her to dispute the other driver's testimony. Mr. Erpenbeck's investigation proved that his client's lights were illuminated & she was NOT stopped in the highway. Mr. Erpenbeck located the officers to confirm that they helped changed his clients tires, and produced the accident reconstruction expert's report to show that his client was NOT negligent in contributing to the wreck. Based largely on Mr. Erpenbeck's investigation, the case settled after a lawsuit was filed.
