Client was charged with violating a temporary protection order, a 1st degree misdemeanor which carries penalties of up to $1,000 in fines and 6 months in jail. In short, the State alleged that Client h ... ad violated the protection order by "texting" one of the protected individuals. After a thorough investigation, it was clear the communication to the protected individual was an accident on the part of Client. At the final pre-trial, I argued to the prosecutor that this was a mistake and that the charges should be dismissed. I pointed out several holes in the State's case and the charges were ultimately dismissed without cost for Client.
