We stripped off the second mortgages on two residential properties and modified the first mortgage on the rental property, thereby making it profitable again. The Plan was confirmed in less than 9 mont ... hs after the bankruptcy case was filed.
OUTCOME: Bankruptcy case remained closed; discharge not entered
Debtor filed a chapter 7 bankruptcy case in 2011. Her case was closed without entry of a discharge because she failed to file a personal financial management course certificate. In 2012, we obtained a ... judgment against the Debtor and started garnishment of her wages. To stop the garnishment, in 2013 the Debtor attempted to reopen her bankruptcy case, file a personal financial management course certificate and obtain a discharge. I followed the Debtor into the bankruptcy court and argued to the bankruptcy judge that it was too late to reopen the case. The judge agreed, refusing to reopen her bankruptcy case, so no discharge was entered. We were able to continue collection of the judgment against the Debtor.
