This case was filed against a Tax Increment Financing District and several of its Board Members. The action alleged, against the District only (1) breach of contract, (2) breach of duty of good faith ... and fair dealing and (3) wrongful termination. Additionally, the Complaint in this case alleged that defamatory statements had been made by Board Members publicly commenting on an independent forensic examination of Plaintiff’s billings to the District. The original amount claimed by Plaintiff was $1,488,199.22. The District filed Motions seeking Summary Judgment and the parties agreed to mediation. The action was settled through two separate (non-confidential) settlement agreements and by two separate stipulations to dismiss the case with prejudice. Plaintiff’s $1,000,000 defamation claim was settled for $0.00. Plaintiff’s remaining claims, then totaling approximately $663,950 plus attorney’s fees, were settled for $250,000.
